Where Can You Consume Cannabis in MA?

This is one of the most commonly misunderstood parts of Massachusetts cannabis law. Just because cannabis is legal to buy does not mean you can use it anywhere. The rules around consumption are strict, and violating them can result in fines.

• Public transit vehicles and platforms

Smoking or vaping cannabis in public carries a civil fine of up to $100 in Massachusetts. It is treated as a civil infraction, not a criminal offense, but it is still a ticket you do not want. However, anything above 1 ounce that you keep at home must be stored in a locked container or secured area. Leaving loose cannabis accessible is technically a violation if it exceeds the 1-ounce public carry threshold.

Cannabis and Driving in Massachusetts

Massachusetts has a zero-tolerance policy for impaired driving, and cannabis is treated the same as alcohol in this regard. Operating a motor vehicle while under the influence of marijuana is an OUI (Operating Under the Influence) offense that carries serious legal consequences.

The penalties for a first OUI offense involving cannabis in Massachusetts include:

• Up to 2.5 years in a house of correction
• Fines ranging from $500 to $5,000
• License suspension for up to 1 year

Visiting From Out of State?
